1. Acceptance of Terms

By installing, accessing, or using Gmail Sense ("the Extension"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not install or use the Extension.

2. Description of Service

Gmail Sense is a Chrome browser extension that integrates with your Gmail account to provide the following features:

• Reply Tracking: Reads your email threads and displays reply-status badges and time-since-last-message indicators directly in your Gmail inbox.
• Email Reading & Analysis: Reads email metadata, headers, thread structure, and message content locally in your browser to power inbox insights.
• Sending Emails on Your Behalf:Sends emails through Gmail's API using your authenticated account when you use the Sequence Sender or any Extension compose feature.
• Email Scheduling:Queues outgoing emails locally and sends them at configurable intervals or scheduled times via Gmail's API.
• Personalized Email Sequences: Composes a message template and sends it to multiple recipients with automatic first-name insertion using the {{name}} placeholder.
• Follow-Up Tracking: Monitors thread activity to surface unanswered conversations based on elapsed time.

3. On-Device Processing & Google API Compliance

Gmail Sense is built on a simple, verifiable privacy principle: everything happens on your device, in your browser. Every feature — reading your inbox, composing sequences, scheduling sends, personalizing emails — runs entirely as local extension code inside your Chrome browser. No email content, subject lines, recipient addresses, Gmail addresses, or message bodies are ever transmitted to or stored on any server we operate.

When you send or schedule an email, your browser calls the Gmail API directly. We are not a relay or intermediary — the email goes from your browser to Google. Closing the Gmail tab immediately stops all extension activity. There is no background process on our side, because there is no "our side" involved in handling your data.

Gmail Sense uses the Google Gmail API and its use of that API complies with the Google API Services User Data Policy, including the Limited Use requirements. By using the Extension, you also acknowledge that:

• Your use of Gmail is subject to Google's Terms of Service and Privacy Policy.
• We use Gmail API data only to provide the Extension's features to you directly. We do not sell your data, use it for advertising, or share it with third parties.
• We do not store your Gmail address, email content, recipient lists, or any data derived from Gmail API access on any server we own or operate.
• We are not affiliated with, endorsed by, or sponsored by Google LLC.

4. User Account and Authentication

To use Gmail Sense, you must:

• Have a valid Google account with access to Gmail
• Authorize the Extension to access your Gmail account via Google's OAuth 2.0
• Maintain the security and confidentiality of your Google account credentials
• Be responsible for all activities that occur under your account through the Extension
• You can revoke access at any time via Google Account Permissions

5. Permitted Use

You agree to use Gmail Sense only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Extension in any way that violates applicable laws or regulations
• Use the Sequence Sender or scheduling features to send spam, phishing messages, unsolicited commercial emails, or any content intended to harm or deceive recipients
• Attempt to reverse-engineer, decompile, or disassemble the Extension
• Use the Extension to access Gmail accounts you are not authorized to access
• Redistribute, sell, or sublicense the Extension without our permission
• Use the Extension in a manner that violates Google's Terms of Service or the Gmail API's acceptable use policies
• Attempt to bypass or disable any security features of the Extension

6. Email Sending, Scheduling & Sequence Sender Terms

Because Gmail Sense can send emails on your behalf, schedule outgoing messages, and execute personalized sequences, you accept the following responsibilities:

• Authorized Sending: You may only send emails to recipients who have consented to receive communications from you or with whom you have an established business or personal relationship.
• Legal Compliance: You are responsible for complying with all applicable email laws and regulations, including the CAN-SPAM Act (US), GDPR (EU), CASL (Canada), and similar legislation in your jurisdiction.
• Accurate Sender Information: Emails sent via the Extension must include accurate sender details, subject lines, and content. Misleading or deceptive email content is strictly prohibited.
• No Spam or Abuse: The Sequence Sender and scheduling features must not be used to send bulk unsolicited email, to overwhelm recipient inboxes, or to conduct phishing or social engineering campaigns.
• Unsubscribe Mechanism: Where required by law, you must include a clear and functional unsubscribe mechanism in emails you send via the Extension.
• Gmail Sending Limits: You acknowledge that Gmail imposes daily sending limits. The Extension does not override these limits, and we are not responsible for emails that fail to send due to quota restrictions.
• Scheduling Responsibility: Scheduled emails are your responsibility. Verify recipients, timing, and content before scheduling. We are not liable for emails sent in error due to incorrect scheduling.

7. Intellectual Property

Gmail Sense and its original content, features, and functionality are owned by us and protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not use, copy, modify, distribute, or create derivative works of the Extension without our explicit written permission.

8. Disclaimer of Warranties

Gmail Sense is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The Extension will be uninterrupted, secure, or error-free
• Reply-tracking indicators will be accurate in all cases
• Emails sent or scheduled via the Extension will be delivered to all recipients
• The Extension will be compatible with all Gmail versions or configurations
• The Extension will meet your specific requirements or expectations

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Your use or inability to use the Extension
• Emails sent or scheduled through the Extension not being delivered
• Errors in reply-tracking or follow-up detection
• Any unauthorized access to or alteration of your data
• Disputes with email recipients regarding message content, timing, or delivery
• Consequences arising from emails sent in error due to misconfigured sequences or scheduling settings

10. Email Delivery Disclaimer

Gmail Sense does not guarantee email delivery. Delivery depends on factors outside our control, including recipient server configuration, spam filters, Gmail sending limits, and network conditions. We are not responsible for:

• Emails being marked as spam or filtered by recipient email services
• Bounced or rejected emails
• Delivery delays or failures due to network issues or third-party services
• Emails failing to send due to Gmail daily quota limits

11. User Responsibility

You are solely responsible for:

• The content of all emails sent through the Extension
• Ensuring compliance with all applicable laws and Gmail policies
• Obtaining necessary consent from email recipients before sending
• Verifying recipient lists, scheduling configurations, and message content
• Maintaining the confidentiality of your Google account credentials
• Any consequences or damages resulting from your use of the Extension

12. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Extension or any of its features at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

13. Changes to Terms

We may revise these Terms of Service at any time. The "Last updated" date will reflect the most recent revision. By continuing to use the Extension after changes become effective, you agree to be bound by the revised terms.

14. Termination

You may stop using Gmail Sense at any time by uninstalling the Extension and revoking OAuth access via your Google account settings. We may terminate or suspend your access to the Extension immediately, without prior notice, for conduct that we believe violates these Terms, violates applicable laws, or is harmful to others — including sending spam or unsolicited emails via the Extension.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
